Provisional licence, points, driving test

Recently I have been getting a lot of queries about penalty points on the UK provisional licence and how it affects their ability to take the UK driving test.

First of all I'm amazed at the number of learner drivers who have points on their provisional licenses, and I begin to wonder what their supervising drivers where doing (or maybe they were not being supervised)! You should be aware that if you are supervising a learner driver, and he/she breaks the law, that you could also be prosecuted for aiding and abetting.

Back to the question about points on provisional licenses and the driving test, here are some facts you need to know.



1. Any points added to your provisional license will stay on for a minimum of 4 years.

2. There is no driving course or any other means of getting points removed or taken off your license, they can only be removed after the statutory time has expired.

3. Points are not automatically removed from provisional licenses, you have to apply to the DVLA and pay a fee for the points to be removed.


4. Points on your license will not stop you from taking the driving test, but if you have more than 6 points on your provisional license, then your license will be revoked under the new driver act! Your pass certificate along with your provisional license will be sent to the DVLA, and you will get a letter back advising that you are once again a learner and need to pass the driving test again.



5. 12 points or more on any UK driving license means a ban, though there are a few solicitors companies that can help you avoid losing your licence depending on your individual circumstances.

6. Points on driving license usually results in higher insurance premiums

So for all you provisional driving license holders out there, drive carefully, don't break the law otherwise it is going to cost you in time and money to get your full driving license.

    If you only have 3 points after passing then NO. If you had 3 points before passing and the get another 3 points after passing, then YES.

    The default penalty points for speeding is 3 if you don't contest the speeding ticket in court, and were caught by camera and the police don't decide to prosecute you.

    If you are prosecuted, then the magistrate can decide to give you more than the normal 3 points depending on the case. In summary if caught by camera and no prosecution, then 3 points is what you are looking at.

    All the info on this page is taken from the DVLA website, you might have 12 points on your licence, but if they were not accumulated within 3 years, then that might be why they haven't revoked your licence (points stay on for 4 years).

    Also as has been mentioned, points don't automatically get removed, so some of those points might no longer be valid.

    In any case you need to think about your attitude towards driving, as having 12 points before passing the driving test doesn't give a good safety picture, and you still have 2 years of probation, and all you need now is to get points on your licence to go back to being a learner again.

    Russ, you can still take the DSA practical driving test if you have 3 points on your licence, but you don't want to get any more points if you passed, due to the new driver's act.

    Well im afraid you are wrong about points on your provisional licence. I have 8 points on my and about to sit my test,phoned DVLA and they advised me if i get any more points within 2 years it will be revoked.

    I have 6 points on my provisional license for driving without insurance.. i passed my test in june and yesterday i was caught speeding doing 40 on a 30. What will happen now, since I have the 6 points from my provisional license? The police were helpful and said something about the fact that the matter has to be taken to court where your defence would be the 6 points on your license were given on the provisional, not the full license. I am in a hole and i really need advice of the best way to go about getting out of this mess,i was caught driving my sister in laws car with a provisional license.and to make the matter even worse the police man told me that i am not insured to drive that car...!!!my response was that i dont need to display L or supervised beacause i had a foreign license which was valid for twelve months when i took my P license,regarding the insurance i said am insured beacause the car has comprehensive insurance,the officer said as i am already in this country more than one year that rule of P license does not apply and for the insurance my name has to be included and in this country we insure the drivers not the cars.the car was taken and my reckoning day was 12 of this month in Hendon court where i was fined and 300 and 8 points on my P license...!!!I have a practical booked for Feb 2009,Please advice What now for me?????

    You can call the DVLA and speak to them, the DSA can't stop you from taking the driving test, but the DVLA decides if to revoke your driving licence or not.

I was stopped by police driving with provisional licence the reason was I have passed the red light but, I am 100% sure that it was amber whan I passed the stop line. anyway I have had a letter form the police said that I had committed two offences which are>>>>failing to display the L plat and passing the red light. I have my driving test booked in 10 days and I have`t heard any thing coming from the court.what do think it may happen or points am I going to lose?

    my partner got caught speeding on 14th of december 2008 doing 45 in a 30. He already has 3 points on his licence for speeding and he had been driving 2 years on 19th of december 2008 which was 5 days after he had been caught. the police officer spoke to him and said that they will be in touch with a court letter which we have just recieved and he has court on the 18th of febuary which is 2 months after he got caught speeding. he either has 2 plead guilty not guilty but what is the chance he will get given 3 points and will he loose his licence ? as he was it was jst under 2 years or is it from when the points are issued at court

    I think you'll have to wait till the outcome of the court case before you will know what happens. 45mph in a 30 zone is quite high, and considering the previous speeding offence, the magistrate could issue a ban!

    i passed a camera earlyer today and am not dsure how fast i was going no more than 35 in a 30, but from my point on leaving i didnt see one speed limit sign up untill a few meters away from the camera , would the camera have flashed me and wen will i be notified if it did,

  24. two years ago i recieved 7 points on my pprovisional licence, i am just wondering if i take my test will my licence be revoked? and from what date is it your points come off... 3 years after your recieved the points in court or 3 years from the day i pass my test?

    Hi,

    I recently passed my test with only 2 minors.

    However I previously had 8 points on my Provisional License for driving without insurance. This didn't stop me from getting my Full license though.

    The Driving Test examiner said that because I had already had 8 points on my provisional license that if I incurred any more points within 2 years of passing then I would have my license revoked & be a provisional driver again.

    I got caught doing 38 in a 30 zone (I thought it was a 40MPH zone & it wasn't signposted saying it was 30MPH)

    I got a fine & 3 points on my license. The police have kept my license to send back to the DVLA.

    So I'm assuming when I get it back it will be a Provisional License.

    I ask this because my driving instructor seems to think that when I passed I would have been allowed 6 points within 2 years.

    Is he right? I don't think he is.....

    hi i recieved 3 points a day before my car test for not having l plates on my moped. after passing my car test and full bike test i recieved another 3 points for speeding on my motorbike in my probationary period. would you advise me to go to court and try and recieve a ban or accept that both my car and bike licences have been revoked?

    The 6 point limit applies on gaining any points. Hence it only applies if you get any new point within 2 years of getting your first full licence if that puts the total of unexpired points to 6 or more. So pass you test while having 6 points on your licence and you are OK, but even one point would result in your licence being revoked.

    hi i have been i bit supid and for last coupls years been driving with no licence, i got caught last month, but since getting pulled over i have took my theory and passed and got my practical booked for 2 days before my court date, i currently have no points on my license, but im afriad that the point i get 2 days after will make me a learner again and i couldnt hack that.

    There is nothing you can do, you will have to face the consequences. Any points added to your licence will be back dated to the day of the offence, so will not have any effect on you passing the test. If on the other hand you are banned from driving totally, then you won't be able to drive again until after the ban. Whether you go back to a learner will be decided by the DVLA and the courts.

    You might want to go to some of the legal forums for advice or check with a solicitor.

  40. hello there. i need some advice as this is bothering me a lot. i was caught by the police driving on a provisional licence with no L plates. i know im a bit stupid but im just helping a friend but the risk is there. i got no points in my prov licence. i told the police that i will have my practical test in 4 days time. they said i need to wait for a court summon. luckily, i passed my practical test but it is stressing me out until now as i dont know if there will be penalty points on my full uk licence. please i need your help. thanks

Now when i was planing to take a test i got caught by a speed camera and i got NIP saying tht i was 49mph at 30 zone.     I have a problem please could you help,

    I have just passed my drivers test, but 4 months ago I was caught driving without insurance and with a provisional,

    the cops said the fine will come through the post within 6 months,
    right now im guessing the 2 penalties i got will add up to more than 6 points.

    Now heres the confusing bit, I dont have any points on the provisional as the fine hasnt come through the post yet,

    Ive just passed and the examiner has taken both parts of my license and sent it off for a full uk license, I am wondering when my full license comes, will it have the points on???? considering the fine HAS NOT come yet.

    and once i get my full license THEN the fine comes and it is more than 6 points, will my license be revoked?? i am not sure on this point beacuse I was caught with a PROVISIONAL way before i had a FULL license.

    Also if the fine doesnt come within 6 months... or comes after 6 months... That means Im home free????

    I passed my test a few years ago now and after just over 2 years of passing i finally came round from changeing my provisional liscence to a pink one only to find i have to re take my theory test driving test everything! But recently ive heard they have stopped this now and woundered if it was true and if so is there anything i can do about mine?

    The DVLA requests that you should apply for your full british driving licence within 2 years of passing the practical test (date pass certificate is issued). You should contact the DVLA directly to see if there is any chance of an exception being made, otherwise you will have to go through the whole process again.

    Hi, recently i was caught speeding 3 times and recieved a toal of 12 points on my licence. However as iv been driving for under 2 years my licence was revoked under the New Drivers Act after the first 6 points. As my licence was rovoked im currently not under any ban or disqualification, i just want to know if it is possible to obtain a P licence and go on to pass my test again and get a full uk licence with 12 points.     Hi i have passed my test for almost a year now and when i passed my test a had 8 points on my provisional licience that got carried over onto my full licience i then got caught speeding 2 weeks after i passed my test which i recieved 3 points for which took me up to 11 points i then got notified from d.v.l.a that they were revoking my licience under the new drivers act but i want to no if i resit my tests again will all these points carry onto my new licience and if so how will thatr work with the new drivers law please reply in yrgent need of advice before i resit my theory test and practical test yours thankfully sharon.

    @ Anonymous A traffic offence dealt with via endorsements and penalty points on a license is not a criminal conviction.

    @ Sharon Points will stay on your licence for a minimum of 4 years from the date of conviction, so resiting your theory and practical test will not make them go away. Once you do get your licence back the new drivers act no longer applies but normal totting up rules which means that if you get anymore points than the 11 you will get banned for at least 6 months.

    It is the responsibility of the supervising driver to make sure the provisional licence holder obeys driving laws, which is why they have to have 3 yrs experience.

    It is therefore possible for the supervisor to be fined for aiding or abetting an offence and be fine also. This applies to driving instructors as well.

  54. hi i really need some advice regarding an incident a couple of days back, as it is really worrying me. i have a full uk licence and i was supervising my partner who has a provisional licence and was not insured on my car. It was one'o clock in the night so i thought it was safe to take her around for a driving lesson. The police stopped us as apparently she was driving very slow.The police man was very rude to us and gave my partner 6 points and a fine of £200, my partner also has a full overseas licence and she was not learning to drive but was just going a bit slow. The police said she has to come to the police station with her provisional licence to get the points and pay the fine in 28 days. I think it's really unfair to fine £200 and 6 points.

    I donno about how the police behaved.... But it's common n usual for the police to give 6points for driving without insurance and £200 fine for driving without a valid UK licence....

    You are looking at a minimum of points on licence, possible prosecution since you were driving on motorway with a provisional.

  68. Hi all, really need help on this one! I am a provisional driver and was planning on booking my test in a few weeks time. I have my own car that myself and my partner are insured on, he supervises me to drive. He has been passed 6 years with no claims. He went out in my car earlier in the day and had taken my L plates off. We then went out late on the night and i was pulled over for driving too cautiously (I was doing 20mph in a 30mph zone, due to my partner eating at the time and it being so late at night, i didn't feel the need to put my foot down. After all its a maximum of 30mph not minimum!!) anyway the police decided to give me a £60 fine and 3 points on my licence which i feel is really unfair, i don't mind accepting the fine but the points aswell seems very harsh! I wasn't even aware that the L plates were a big legalarity and was not aware they had been taken off! I have never been in trouble with the police before or pulled over, I do not speed, jump red lights etc, I like to think I am a good driver and this has really put me off continuing learning to drive now :( Is it worth me contesting the points???     I had a provisional license plus a valid US license. I was pulled over last week and got a code 064 offence for driving without insurance. I have been in the UK for more than 12 months, so I could not be legally using my foreign license.

    Once, I got home, I scheduled a practical test right away, took the test and passed it.

    Prior to the whole incident, I had a speeding ticket, which is worth 3 points.

    So what happens now? Do I get a full uk license and get it revoked right away? This seems a little harsh to me given the timing of the events. What do you think? Also, I decided to appeal the no insurance offence.Any chance that the 6 points won't be added to the license??

    My brother was given a £200 deposit for 'cheaper' insurance, that he said he would sort out for me as my quotes were high. 6 weeks later i get pulled over by police saying i have no insurance. I said i gave him a deposit so they have give me 7 days to produce documents. My brother has confessed to spending my deposit, so now i have just insured my car myself, but i face a fine and 6 points. I have been driving 2 years in september, so will they take 6 points form 12, or go back to the day of the offence. Where do i stand considering i was driving round non of the wiser.

    all sounds good here aquestion for you all

    i passed my motor bike test in 1989- a few days befroe i got banned from driving(( in my car) i have a full car licence
    but after the 6 months i was driving my car and bike again for years no prob
    but now i just sent me pape one back for a plastic card
    and it has not got my motor bike on there only as a provisional

    here the think i had a argment with the instructor as he fail me for speeding
    40 -in a 30 But the road in question had then a 40 sign on
    then at a junction on a bypass after the road works stoped before the junction i did all the correct moves and open her up to 60 so as the junction was say 150 yards or so i prob doing 40 when on the other side of the junction was the no speed limte sign

    so he failed me ? i had ago and try to reason with the man but no joy so i did it again and all was well untill a one way street going down the the right way and we where turn left at the bottom i kept to the left ish of the road he ail me for this
    What that all about i dont know power happy i belive i said to him that madness you cant drive down the rigt side of aroad even if it a one way street but he fail me for it.

    So now i just drive my bike when i want to under a A provisional i not got stoped yet.
    i would try to do agine but i hate the fact i know i have passed years ago. plus as i work away alot in dif countrys i dont get much time. now it over 2 years so would i have to do it all again or is there a way to make them ADD A FULL MOTOR BIKE TO MY LICENCE ??

    Hello I was wondering, if you have 6 penalty points on your licence before taking a test would you still be eligible to take your car test? Thanks

    hi i passed my test in feb 09 i got caught with no insurence in april 09 i passed my theory in october 2010 i got 7points and 200 pound fine in june 09 i have my driving test on the 18th a jly 2012 will my licence be revoked or will i be able to drive after i pass my test plz help confused.com

  81. i have 11 points on my provisional licence. my pratical test is schedule for jan 2015. would i be allowed to do the test? would they issue me full licence if i pass

    1. Yes, as long as you have a valid provisional licence, you will be allowed to take the UK driving test by the DVSA examiner. If you do pass, then any additional points on your licence will automatically take you over the 12 points limit, so usually meaning licence revoke.

  86. When you apply for a provisional licence, It will come with the 6 points on it. If you don't apply, then the record of the 6 points will be kept for 4 years.

    1. If your licence is revoked, you can't ride until your ban is up. CBT lasts for 2 yrs, so if it is still valid when you get your licence back, you are OK, otherwise you will have to do it again

  88. hiya , in 2013 i drove the car with provisional licence and i got 6 points as my car was not insured in 2016 June my points was expiring . in Feb i stooped by officer as i was driving in one way road , but but when he asked me i gave him false answers he seized my car cause and he detained me , i came out next day after checking that it was my car and it was insured with comprehensive insurance . but i was already booked the practical test on feb 2016 which passed i sent the certificate to dvla and they sent me the full licence now . so officer sent me a envelop of court to prid guilty , also when i read everything they told me that their charging me driving without full driving licence , now i have it . please tell me if i can save my licence back . please i am appreciating your job . thanks respect .

  90. Hi I've held a full license for nearly 10 years. I got banned in 2013 for dangerous driving and also a custodial sentence. Cut along story short my ban was up on 1/10/2015 and I sent a D1 form and a cheque for £65 for my license back. I've been pulled by police and after he checked me out he said I was banned. Then he said I had a provisional. Im in court on 8/6/2016 for driving without the correct license and no insurance when im fully comp. plz can u tell me wot I can do? Im a 27 year old girl and im panicking a lot. Thanks x

    1. From what you are saying, it looks like when you were banned you needed to take a test after the ban was up for you to get your driving qualifications back. If you sent a form to the DVLA/DVSA did you get a full licence back, if you did, then all you need to do is present that with your insurance certificate in court. As long as there is no red 'L' on the licence it is full, otherwise it is provisional which means you have to take the test again.

      It is YOUR responsibility to know the rules and abide by them. Good luck.

  91. guys i will tell you what happens if you have any points on provisnal license up to 11point you can take your test but your license wont be revoked because your havnt got driving licence .if you had driving licence ans you had 6 point the law states you have to take extened test or banned .but if you have been banned my court.you will have to take extened test.but dont worry guys i went trough this .
